Import of wine


After the entry of the Czech Republic the EU, wine import means only wine import from third countries. For the trade within the EU, free circulation of goods is applied, provided that wine complies with EC legislation requirements.

Specific regime is applied for wine import from third countries. This means that there are specific conditions for import from third countries in the wine sector.

Wine import from third countries is regulated by Regulation (EC) No. 1308/2013 and Regulation (EC) No. 555/2008.

Conditions for wine import from third countries into the EU

Obligation to present at the point of entry (Council Regulation (EC) No. 1308/2013, Art. 90 Para 3, Commission Regulation (EC) No. 555/2008, Art. 40-42):

The certificate and the report on the results of the analysis are completed on a separate form VI 1 (Annex IX to Commission Regulation (EC) No. 555/2008) or VI 2 (Annex X of Commission Regulation (EC) No. 555/2008).

Notification obligation

A receiver of bulk wine, fresh grapes other than table grapes, must, rectified must concentrate or pomaces transported from other EU Member State or a third country, shall immediately notify of this arrival into the first place of delivery on the territory of the Czech Republic, by 12 hours after this arrival at the latest. According to Section 14 a Para 2 of Act 321/2004 Coll., on Viticulture and Viniculture, the Receiver also provides information on the amount to the Register.

The real particular place where these products are present is notified (i.e. where they were unloaded and stored), not the address of the companies where these products cannot be stored.

Pursuant to Section 14a, the notification obligation is mandatory to the receiver of bulk wine and is carried out notifying CISTA by means of the Farmers’ Portal completing the relevant form.

The receiver is, in the meaning of Section 14a) of Act No. 321/2004 Coll., on Viticulture and Viniculture, the operator who is indicated as the receiver in the accompanying document made for the purposes of the transport into the CR.

To duly comply with the notification obligation, the operator shall be registered on the Farmers‘ Portalin due time (it is not possible to make the registration during a weekend!). However, notification during weekends is possible for registered operators. To enter the notification into the Register, the relevant form shall be filled correctly.

In case of failure to notify fresh grapes, must or pomaces, from which wine without PDO/PGI is made, certification of the must variety or vintage year will be rejected at such wine.
