Information on CAFIA´s approach to the application of Act No. 106/1999 Coll., on Free Access to Information

I. General Section

The submission of requests to CAFIA for the provision of information and its provision by employees of the Authority is regulated by Act No. 106/1999 Coll., on Free Access to Information (hereinafter referred to as the Act). CAFIA also applies this Act in accordance with the Analysis of the Effectiveness of the Act on Free Access to Information from December, 2007, which was produced on the basis of the Government Decree No. 1199 from 25th October, 2006, which may be downloaded from the Ministry of the Interior website.

II. Procedure for Processing an Application

The application must be processed in accordance with the Act. The legally bound persons are the individual regional inspectorates, including the Headquarters.
An oral request for information may be submitted at any CAFIA Inspectorate, or by telephone on any available CAFIA telephone number. The inspectorate recommends using the phone number for the Unit of Communication with Consumers at the Headquarters, No.: +420 542 426 630. Information requested orally will be provided immediately if it is available. If an oral application cannot be processed immediately, the applicant is requested to submit the application in writing (by letter or electronically). The form in the annex to this article may be used to make a written application.
A written application may be sent to the address of the chosen CAFIA Inspectorate. Addresses are stated on this website under the link to Organisational Structure.
Applications in electronic form may only be sent to the CAFIA electronic mailroom epodatelnazavinac.gifszpi.gov.cz. Such applications must state which Inspectorate they should be sent on to. CAFIA also accepts and processes requests via its data boxes.  
Payments for the costs of providing information are set out in the Pricelist for the Provision of Information:

In the case the time necessary for looking up and processing of the information takes less than 4 hours, the information will be provided for free. Otherwise, the information will be charged compliant to the above tariff.

III. Failure to Provide Information by the Inspectorate

The relevant Inspectorate shall issue a statement on the refusal or partial refusal of a request for information. This statement is a decision in accordance with § 67, Act No. 500/2004 Coll., Rules of Administrative Procedure, and must be in accordance with § 68 of the Act.

An appeal against a refusal to provide information may be made within 15 days of the decision of the Inspectorate. In the cases stated in §16a paragraph 1) of the Act, a complaint may also be made against the processing of the application for information, with a 30-day deadline, in accordance with §16a and paragraph 3.
