The Czech Agriculture and Food Inspection Authority controlled cigarette and pipe tobaccos

04/30/2001

The Czech Agriculture and Food Inspection Authority focused its inspections carried out in February and March on correct labelling of the pipe and cigarette tobaccos and on the declared weight of their consumer packaging.

The inspectors took 32 samples of pipe and cigarette tobaccos in the importers' premises and in wholesale warehouses, of which 19 (59.4 %) did not comply with requirements of the law. The absolute majority of cases (15) did not observe the requirements for a prescribed size of the area bearing a special health warning notice ("The Ministry of Health warns: …").

The inspections also paid attention to the observance of the declared weight, but only in 17 of the samples taken, which was due to the change to legislation. Lower weight than declared on the label was identified in 11 samples (64.7 %). In the opinion of the specialists, it was due to the unsuitable packaging selected that did not prevent the tobacco from drying up.

The law does not allow inflicting penalty directly on the persons inspected in the cases where the health warning notice in products was printed on smaller area than prescribed by the law. Therefore the Inspectorate has taken corrective actions in order to remove the non-conformances identified and sanctions will be imposed only if these actions are not observed. Infliction of penalties for non-observance of the declared weight has already been proposed in the instituted Administrative actions.
