The Ministry of Health announced a new extraordinary measure regulating gradual releasing of the market with spirits containing 20% of alcohol or more including “tuzemák” and “konzumní líh”.
The new extraordinary measure applies to all food business operators including subjects running catering establishments, and it bans offering to sale, sale and further forms of offering to consumption by a final consumer of spirit drinks containing 20% of alcohol or more including “tuzemák” and “konzumní líh” which were produced after 31. 12. 2011, unless they are accompanied by a document on their origin pursuant to Government Regulation No. 317/2012 Coll. laying down the form of the document on the origin of certain sorts of spirits, distillates and certain sorts of spirit drinks (at all stages of putting on the market).
Food business operators are further banned from export and distribution of spirit drinks containing 20% of ethanol or more including “tuzemák” and “konzumní líh” which were produced after 31. 12. 2011 outside the territory of the Czech Republic, unless they are accompanied by a document on their origin pursuant to Government Regulation No. 317/2012 Coll. at all stages of putting on the market.
Food business operators including subjects running catering establishments are ordered to destruct in compliance with Act No. 185/2001 Coll. on Wastes and amendments to certain acts spirit drinks containing 20% of ethanol or more including “tuzemák” and “konzumní líh” contained in a packaging for consumers of which checking strip was damaged or torn by opening of this packaging. This shall be carried out within 60 days from announcement of this measure. The exception applies to spirit drinks containing 20% of ethanol or more including “tuzemák” and “konzumní líh” at which unwholesomeness is proved by a record on testing issued by an accredited laboratory.

This extraordinary measure replaces the extraordinary measure of 20.9.2012, ref. no. MZDR 32764/2012 and it is binding by the moment of its announcement in the national TV and radio broadcasting, i.e. since Thursday 27.9.,13:15.
The extraordinary measure will be lifted by the same procedure, thus announcing in the national TV and radio broadcasting.
