Designation “Valašský frgál” has been a protected geographical indication (hereinafter “PGI” only) since 26 December 2013 pursuant to Council Regulation No. 1151/2012 on quality schemes for agricultural products and foodstuffs. During inspection of products with this designation, besides general requirements of food law, also compliance with PGI specification “Valašský frgál” will be checked, in particular use of appropriate raw materials, production method, geographical area, final product, required documentation and labelling.
Producer that intends to use PGI “Valašský frgál” for its products has no further registration obligation beyond the notification obligation pursuant to Section 3 Para 1i) of Act No. 110/1997 Coll. CAFIA carries out verification of compliance with the specification before the product is put on the market, either based on own detections or based upon the request of the producer. Costs for the verification of the compliance with the specification pursuant to Article 37 Para 1 of Regulation No. 1151/2012 on quality schemes for agricultural products and foodstuffs are born by the food business operator. These costs are charged pursuant to Section 16 Para 8 of Act No. 110/1997 Coll. and they comprise a flat rate and possible costs for laboratory analysis. The flat rate of the costs pursuant to Decree No. 227/2008 Coll. is 500.- CZK for one inspector and for each started hour of the working performance.
The geographical area where Valašský frgál may be produced is specified in Point 4 of the specification.
Raw materials:
The producer is allowed to use only raw materials given in the specification of the PGI “Valašský frgál”.
Alternative sweetener given in Point 3.3 of the specification is not meant as an additive of which addition into fine bakery products (which comprise “frgál” as well) is not allowed pursuant to Regulation of the European Parliament and Council (EC) No. 1333/2008 on food additives, but it is different kind of food saccharide, fructose in particular.

During the check of the recipe of the production of the basic pastry, minimum weight proportions of fat, sugar, egg yolk pursuant to Para 2 of Point 3.3 of the specification are assessed in the baked pastry.
Production:
Specification defines some specific production procedures, namely in Point 5.2 of the specification.
The specification lays down that frgál may be single-component only.
Pursuant to Point 3.5 of the specification, the whole production (except for production of fillings) shall be carried out in the defined geographical area.
Packing and labelling:
Cutting and packing of products is carried out at the producer. Frgál is put onto a paper pad and packed as a whole piece or divided into halves or quarters. Frgál may be packed into containers or carrier boxes or directly at the producer.
If the producer packs frgál into containers or carrier boxes that contain more pieces, he shall ensure that the products are not damaged by breaking, squashing or violating hygiene legislation.
Each packaging shall be appropriately labelled - the label shall contain entire mandatory information on the product, as laid down by legislation (in particular ingredients, allergens, producer, use by date) and also information required by Regulation No. 1151/2012 and PGI specification of Valašský frgál, i.e. registered denomination “Valašský frgál” and logo of PGI in colours and size laid down by Commission Regulation No. 1898/2006.
In case of sale of unpacked products, the place shall be clearly provided with information on the sale of Valašský frgál with the PGI logo.
Check of documents:
In the place of production, documents related to traceability, i.e. documents related to raw materials and sale of the finished product are checked pursuant to Article 18 of Regulation of the European Parliament and Council (EC) No. 178/2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety. Documents related to production are checked as well.
The seller in the place of sale shall be able to document who is the producer of frgál and show further documents related to traceability. The documents shall be in compliance with the labelling of the offered products.
