Prague beer house U Zlatého tygra repeatedly tapped short measured beer

The Czech Agriculture and Food Inspection Authority (CAFIA) has been authorised to carry out inspections of public catering premises since 2015 and checks, inter alia, the volume of the served beverages including tapped beer.

Within these inspections, the CAFIA inspectors repeatedly revealed non-compliant volume of served tapped beer in beer house U Zlatého tygra (inspected person: Jan Hendrych) on Husova street 228/17, 110 00 Prague. The volume of the tapped beer was by 10 – 15% lower at all 7 samples assessed during two inspections carried out at these premises.

The first inspection was carried out in May 2015. Two CAFIA inspectors ordered 2 glasses of draught beer of 0.5 l volume. After the waiter brought the beverages, the inspectors proved their identity by service identity cards and measured the volume of the beers. The values of measuring were as follows: volume of the first sample – 0.428 l, volume of the second sample – 0.448 l. The operator thus violated Regulation No. 1169/2011 providing for that information on foodstuffs shall not be misleading in particular as regards the characteristics and the amount. CAFIA imposed a fine within an administrative procedure which has already come into force and the operator has paid it.

The aim of the second inspection held in November 2015, of which 5 inspectors took part, was to verify whether the operator took the measure to prevent misleading consumers. After the waiter brought 5 draught beers, the inspectors proved their identity by service identity cards and measured the volume of the beverages. The values of measuring were as follows: volume of the first sample – 0.453 l, volume of the second sample – 0.457 l, the volume of the third sample – 0.425 l, volume of the fourth sample 0.442 l, volume of the fifth sample – 0.424 l. The operator thus again violated Regulation No. 1169/2011 and CAFIA will initiate another administrative procedure on imposition of a fine with him. The suggested amount of the fine is always higher when the violation is repeated compared to the previous case in order the sanction has desirable motivating effect.
