On Thursday 15 May, Act No 120/2008 Coll., amending the Act on foodstuffs and tobacco products and the Act on the Czech Agriculture and Food Inspection Authority entered into force. The amendment lays down some new obligations on food business operators. The Inspection Authority acquired new competencies, but also obligations too.
Food business operators importing foodstuffs and raw materials from countries that are not members of the European Union or contracting parties to the European Economic Area will be obliged to cover the costs for control of foodstuffs upon their entry on the territory of the Czech Republic. Moreover, food business operators will be obliged to cover the expenses for additional controls if inspectors find that the food business operator did not implement previously imposed measures. Food business operators can be charged for this when implementing Decree of the Ministry of Agriculture laying down flat amounts of these costs enters into force.
Food that is not packed in manufacturing premises and without consumer’s presence will have to have, among others, composition and country of origin on the packaging; this obligation is applicable within three months of the entry into force of the amendment at the latest (i.e. on 15 August 2008). Provisions concerning fines were amended too, for example, the maximum fine imposed when a food business operator does not notify the CAFIA about commencement, change or termination of business operation increased from half a million to one million Czech crowns.
Inspectors can also order business operators to have their products analysed by an accredited laboratory at their expenses. However, such measure can only be imposed if the operator placed unsafe food on the market or if there are reasonable grounds for believing this happened. There is also a new possibility to make control purchases in order to check Internet and mail-order sales.
The amendment of the above Acts brings a number of other small amendments. The Inspection Authority therefore recommend food business operators acquaint with these regulations. Current version of these Acts is also available on our website.
