Majority of food sellers observe the “doughnut” decree

02/28/2003

With effect from 27 January 2003 the Czech Agriculture and Food Inspection Authority commenced controls of compliance with the Decree No. 347/2002, Coll. of L., issued by the Ministry of Health, on sanitary and hygienic conditions of the food selling, which, thanks to media, has become commonly known as the “doughnut” decree.

As yet the CAFIA inspectors controlled business companies covering approx. 60-70% of food selling market in the entire retail trade network. It was confirmed during the first inspection that some two thirds of the sellers observed provisions stipulated in the Decree, as for the remaining one third of sellers, CAFIA imposed the so-called “corrective actions on the detected non-conformances”, which means that the respective stores have to implement relevant provisions of the Decree in practice within a set deadline.

CAFIA has not imposed any penalties yet. If the inspectors, however, identify in the subsequent inspections that the imposed corrective actions have not been implemented, they can proceed to imposing penalties.

The Decree No. 347/2002, Coll. of L., came in force on 6 August 2002. By consent of the Ministry of Health and Ministry and Agriculture, CAFIA postponed controlling of its compliance until the end of last year. At present the controls of compliance with this Decree feature in the regular CAFIA inspection activities.

The updated and full text of the Decree and also its interpretation are published at the CAFIA official web site.
