Certain media recently released information than the ban on smoking in internal areas of public catering premises is mostly violated in bars which are under supervision of the Czech Agriculture and Food Inspection Authority (CAFIA).

CAFIA would like to point out that Act No. 65/2017 Coll., on the Health Protection against Harmful Effect on Drugs in its Section 30 unambiguously lays down competences for single provisions of the Act in question and the wording of the Act says that CAFIA is not competent to check the smoking ban and the use of electronic cigarettes in the meaning of Section 8 and Section 9 of the Act.

The Act delegates the check the given provision to (1.) municipalities with delegated powers and (2.) bodies of public health protection.
