Special conditions governing the import of certain foodstuffs from certain third countries due to contamination risk by aflatoxins

Commission Regulation (EC) No. 1152/2009 imposing special conditions governing the import of certain foodstuffs (identification by CN code and country of origin) - list of these is below this article. It is applied to consignments of a gross weight exceeding 20 kg and to processed or compound foodstuffs containing more than 20% of foodstuffs referred to in Commission Regulation (EC) No. 1152/2009.
Consignments could be imported to EU through the designated point of entry according to Commission Regulation (EC) No. 669/2009. Documentary checks are done in the designated point of entry. Food business operators or their representatives shall give prior notification (at least one working day prior to arrival of consignment) of the estimated date and time of physical arrival of the consignment at the designated point of entry – they shall complete common entry document referred to in Commission Regulation (EC) 669/2009.
The consignment has to be accompanied by common entry document (CED), the results of sampling and analysis and a valid health certificate (in accordance with Commission Regulation 1152/2009) – except almonds imported from the United States which are not covered by the Voluntary Aflatoxin Sampling Plan.
Notes for guidance for the CED in application of this Regulation in case of imports of foodstuffs from certain third countries, due to contamination risk of these products by aflatoxins – below table “List of commodities”.
The competent authority at the designated point of entry shall authorise transfer of the consignment to the designated point of import after favourable documentary check. At designated point of import identity and physical control, including laboratory analysies, is done with a frequency indicated in Commission Regulation 1152/2009.
